The Court adopts Judge Tsuchida’s Report and Recommendation.

Plaintiff’s motion for voluntary dismissal (Dkt. 33) is GRANTED, and
Defendants’ motion for summary judgment (Dkt. 29) is DENIED. This case is
DISMISSED without prejudice.
