Upon application of the United States of America, on behalf of the Court of First Instance

16 No. 3, Jerez de la Frontera, Spain, seeking information from Microsoft who resides within the
17 jurisdiction of this Court, for use in a judicial proceeding in Spain and the Court having read the
18 Letter of Request (Exhibit A to the Declaration of Nickolas Bohl, Dkt. 1-2), from Jorge Luis
19 Fernandez Vaquero, Judge, Court of First Instance No. 3, Jerez de la Frontera, Spain, and being fully
20 informed in the premises, it is hereby

ORDERED, under the authority contained in 28 U.S.C. § 1782 that Nickolas Bohl, Assistant

22 United States Attorney for the Western District of Washington, is hereby appointed as
23 Commissioner to take such steps as are necessary to obtain information from Microsoft in
24 conformity with the legally permissible portions of the Letter of Request (as set forth in Exhibit A to
