1 2 3 4 5 6 7 UNITED STATES DISTRICT COURT WESTERN DISTRICT OF WASHINGTON AT SEATTLE 8 9 10 11 PLINTRON TECHNOLOGIES USA LLC, Plaintiff, 12 13 14 15 CASE NO. 24-93 ORDER DENYING STIPULATED PROTECTIVE ORDER v. JOSEPH PHILLIPS, RICHARD PELLY, THOMAS MATHEW, GREG MCKERVEY, and DESIREE MICHELLE GRAY, Defendants. 16 17 18 This matter comes before the Court on the Parties’ Stipulated Protective Order. (Dkt. No. 19 52.) Having reviewed the Stipulated Order, the Court DENIES entry of the Order without 20 prejudice. 21 The Court appreciates that the Parties have submitted a proposed protective order that 22 largely tracks the District’s Model Protective Order. But the Parties propose an overbroad and 23 vague definition of “confidential material.” As the Model Protective Order instructs, the Parties 24 ORDER DENYING STIPULATED PROTECTIVE ORDER - 1 1 “must include a list of specific documents such as ‘company’s customer list’ or ‘plaintiff’s 2 medical records;’” and may not “list broad categories of documents such as “sensitive business 3 material.’” Model Stipulated Protective Order at 2, available at 4 https://www.wawd.uscourts.gov/sites/wawd/files/ModelStipulatedProtectiveOrder.pdf. Here, the 5 Parties have provided only broad categories of “materials” without any specificity. The Court 6 will consider a more specific and narrow definition of “confidential material” that tracks the 7 Model Protective Order and identifies specific documents, rather than an open-ended and 8 overbroad category of documents. 9 For this reason, the Court DENIES the Order without prejudice. The Court will consider 10 entry of a revised Stipulated Protective Order that addresses the Court’s concerns set forth in this 11 Order. 12 The clerk is ordered to provide copies of this order to all counsel. 13 Dated June 4, 2024. 14 A 15 Marsha J.
