Plaintiff's Motion for Summary Judgment on the unconstitutionality of RCW § 42.17.105(8) is GRANTED. 2. Plaintiff's Motion for Summary Judgment on the unconstitutionality of RCW § 42.17.090 and WAC 390-16-034 is DENIED.
