This matter comes before the Court on the Report and Recommendation (“R&R”)

of the Honorable J. Richard Creatura, United States Magistrate Judge. Dkt. 3. The Court
11
having considered the R&R and the remaining record, and no objections having been
12
filed, does hereby find and order as follows:

(1)
The R&R is ADOPTED; and
(2)
Plaintiff’s application to proceed in forma pauperis is DENIED.
(3)
The Clerk shall file the complaint only on receipt of the full four hundred
14

dollar filing fee. If no filing fee is paid within 30 days of the date of this Order, the Clerk
17
shall close the file.
