This matter comes before the Court on the Report and Recommendation (“R&R”)

10 of the Honorable Karen L. Strombom, United States Magistrate Judge. Dkt. 10. The
11 Court having considered the R&R and the remaining record, and no objections having
12 been filed, does hereby find and order as follows:

The R&R is ADOPTED;

(2)

Plaintiff’s motion to voluntarily dismiss this action (Dkt. 8) is GRANTED;

15 this action is DISMISSED with prejudice; and

(3)

Plaintiff’s motion for rescission of the IFP order and return of filing fee

17 (Dkts. 8 and 9) are DENIED.
