The R&R is ADOPTED; and

Defendants’ motion to dismiss (Dkt. 14) is GRANTED; Plaintiff’s § 1983

claims against Defendants are DISMISSED with prejudice; Plaintiff’s state law claims

are DISMISSED without prejudice.
