This matter comes before the Court on the Report and Recommendation (“R&R”)

10 of the Honorable Karen L. Strombom, United States Magistrate Judge. Dkt. 8. The Court
11 having considered the R&R and the remaining record, and no objections having been
12 filed, does hereby find and order as follows:

(1)

The R&R is ADOPTED;

14

(2)

Petitioner’s motion to stay (Dkt. 2) is GRANTED; this matter is STAYED

15

pending resolution of the state court proceedings. Petitioner shall advise

16

the Court within thirty (30) days of receiving a final State court ruling.

(3)

Petitioner shall provide the Court with a report on the status of his state
court proceedings every ninety (90) days.
