1 2 3 4 5 UNITED STATES DISTRICT COURT WESTERN DISTRICT OF WASHINGTON AT TACOMA 6 7 8 PAMELA S. OWEN, 9 Plaintiff, 10 v. 11 CHUCK E. ATKINS, et al., 12 CASE NO. C15-5375 BHS ORDER DENYING PLAINTIFF’S MOTION AND DISMISSING DEFENDANTS Defendants. 13 14 This matter comes before the Court on Plaintiff Pamela S. Owen’s (“Owen”) 15 motion for judicial notice (Dkt. 53). 16 On October 6, 2015, the Court granted Defendants MTC Financial, Inc., doing 17 business as Trustee Corps (“MTC”), and Bishop Marshall & Weibel, PS’s (“BMW”) 18 motions to dismiss. Dkt. 37. The Court also granted Owen leave to amend her 19 Washington Consumer Protection Act (“CPA”) claim against these defendants. Id. 20 Owen did not amend her complaint. 21 On December 16, 2015, the Court granted Defendants Federal Home Loan 22 Mortgage Corporation (“FHFA”) and Federal Housing Finance Agency’s (“Freddie ORDER - 1 1 Mac”) motion to dismiss. Dkt. 49. The Court also granted Owen leave to amend her 2 CPA claim against Freddie Mac. Id. Although Owen filed a motion for reconsideration 3 that the Court denied, Owen has not filed an amended complaint. 4 On January 31, 2016, Owen filed the instant motion asserting that a tax document 5 proves her claim of an unlawful conspiracy to foreclose her house. Dkt. 53 at 3. The 6 Court has dismissed Owen’s conspiracy claims with prejudice. Thus, the instant motion 7 is essentially a motion for reconsideration that the Court DENIES. 8 With regard to Owen’s CPA claim, the Court has repeatedly granted her leave to 9 file an amended complaint and she has failed to do so. Therefore, the Court DISMISSES 10 Owen’s CPA claim and the Clerk shall terminate MTC, BMW, and Freddie Mac. 11 IT IS SO ORDERED. 12 Dated this 9th day of February, 2016. A 13 14 BENJAMIN H. SETTLE United States District Judge 15 16 17 18 19 20 21 22 ORDER - 2
