This matter comes before the court on the Report and Recommendation of Magistrate
Judge J. Richard Creatura (Dkt. 6). The plaintiff has filed a Motion to Amend Plaintiff’s
Response for November 8, 2017, for Newly Discovered Evidence (Dkt. 7), which the court
deems to be an objection to the report and recommendation. Unfortunately, said response does
not resolve the issues raised in the Report and Recommendation, and the Report and
Recommendation should be adopted by this court Plaintiff’s Motion to Proceed in forma
pauperis (Dkt. 1) and Application for Court Appointed Counsel (Dkt. 1-2) are hereby DENIED.
