The Defendants Motions to Dismiss or in the Alternative, Motion for Summary Judgment [Docs. 52 & 66 are GRANTED. Accordingly, this Court ORDERS tha t the plaintiffs Amended Complaint [Doc. 18 be DENIED and DISMISSED WITH PREJUDICE as to all defendants, with the exception of Counts I and V against defendant Close and Count V against defendant Shifflett. In addition, the pending Letter/Motion fo r Temporary Injunction [Doc. 86 and Motion for Reconsideration of Temporary Restraining Order and Motion to Appoint Counsel [Doc. 92 are both DENIED.
