MEMORANDUM OPINION AND ORDER: The Court hereby ADOPTS 4 Magistrate Judge VanDervort's Proposed Findings and Recommendation in its entirety; DISMISSES 1 Plaintiff's Complaint for the Violation of Civil Rights under 42 U.S.C. Section 1983 with prejudice and DIRECTS the Clerk to remove this action from the Court's active docket. A separate Judgment Order will enter this day, implementing the rulings contained herein.
