Plaintiff may proceed on Eighth Amendment deliberate indifference claims against defendants Kosterman, Tapa, Ervin, Chavez, Friend and Noble. Defendants Schmaling, Hanrahan and Johnson DISMISSED. US Marshal to serve copy of complaint and this order on remaining defendants under FRCP 4; those defendants to file responsive pleading to complaint. Clerk's office to return case to Judge Jones for further proceedings. Parties may not begin discovery until scheduling order entered setting deadlines for discovery and dispositive motions.
