IN THE UNITED STATES DISTRICT COURT FO R THE WESTERN DISTRICT OF WISCONSIN --------------------------------------------LUIS A. RAMIREZ P la i n t i f f , v. JAN E DOE 1 (Dr. Suliene), GREG GRAMS, RICK RAEMISCH, JAN E DOE 2 (S. Sitzman), JAN E DOE 3 (Alsum), JANE DOE 4, JANE DOE 5, JOHN DOE 1, JOHN DOE 2, JO H N DOE 3, JOHN DOE 4, JOHN DOE 5, JO H N DOE 6, JOHN DOE 7, JOHN DOE 8, JO H N DOE 9, JOHN DOE 10, JOHN DOE 11 an d JOHN DOE 12, D efendan ts. --------------------------------------------Plaintiff Luis Ramirez, a prisoner at the Columbia Correctional Institution in Portage, W isco nsin, has submitted a proposed complaint. He asks for leave to proceed in forma pauperis. Because plaintiff is a prisoner, he is subject to the 1996 Prisoner Litigation Reform Act. This means that before this court may decide whether he can proceed with his ORDER 0 9 - cv -3 1 4 - b b c com plaint in forma pauperis, plaintiff will have to make an initial partial payment of the filing fee. From the trust fund account statement plaintiff has submitted, I calculate his 1 in itia l partial payment to be $0.66. Also, he must pay the remainder of the fee in monthly installm ents even if his request for leave to proceed is denied. If plaintiff does not have the m on ey to make the initial partial payment in his regular account, he will have to arrange w ith prison authorities to pay some or all of the assessment from his release account. This does not mean that plaintiff is free to ask prison authorities to pay all of his filing fee from his release account. The only amount plaintiff must pay at this time is the $0.66 initial p artial payment. Before prison officials take any portion of that amount from plaintiff's release account, they may first take from plaintiff's regular account whatever amount up to th e full amount plaintiff owes. Plaintiff should show a copy of this order to prison officials to insure that they are aware they should send plaintiff's initial partial payment to this court. OR DER IT IS ORDERED that plaintiff is assessed $0.66 as an initial partial payment of the $350 fee for filing this case. He is to submit a check or money order made payable to the clerk of court in the amount of $0.66 on or before June 17, 2009. If, by June 17, 2009, plaintiff fails to make the initial partial payment or show cause for his failure to do so, he w ill be held to have withdrawn this action voluntarily. In that event, the clerk of court is 2 directed to close this file without prejudice to plaintiff's filing his case at a later date. E n tered this 28t h day of May, 2009.
