Defendants. ) ) ) ) ) ) ) ) ) ) ) ) Case No. 10-CV-661-bbc JURY TRIAL DEMANDED STATUS REPORT Pursuant to the Court’s May 16, 2011 order in this matter, Defendants Motorola Mobility, Inc. ("Mobility") and Motorola Solutions, Inc ("Motorola") (collectively "Defendants") respectfully submit this status report regarding the ITC Investigations, In the Matter of Certain Wireless Communication Devises, Portable Music and Data Processing Devices, Computers and Components Thereof, Inv. No. 337-TA-745 (“the 745 Investigation”) and In the Matter of Certain Mobile Devices and Related Software, Inv. No. 337-TA-750 (“the 750 Investigation”). In accord with the schedule set for the 745 Investigation, the parties exchanged responses to contention interrogatories on April 15, 2011 and April 22, 2011. The parties exchanged initial expert reports on May 6, 2011 and rebuttal expert reports on May 23, 2011. Discovery will close in the 745 Investigation on June 15, 2011. The parties will serve prehearing briefs on June 24, 2011, and the hearing before Chief Administrative Law Judge Luckern will be held July 25-29, 2011. The ITC is scheduled to issue its initial determination on or before November 8, 2011. The ITC has set a 02426.51761/4170497.1 target date of March 8, 2012, at which time the Commission expects to have completed its final review of the matter.1 With respect to the 750 Investigation, the parties are currently in the middle of discovery. The parties have already exchanged preliminary responses to contention interrogatories on May 10, 2011 and May 17, 2011. The parties will exchange final responses to contention interrogatories on June 10, 2011 and June 17, 2011. The close of discovery is scheduled for July 1, 2011. The parties will exchange initial expert reports on July 8, 2011. The parties will exchange rebuttal expert reports on July 22, 2011. The close of expert discovery is scheduled for August 10, 2011. A hearing before Administrative Law Judge Essex is currently scheduled for September 23 to October 5, 2011. The ITC expects to issue an initial determination on November 30, 2011.
