From the affidavit of indigency accompanying plaintiff's p r o p o s e d complaint, I cannot determ i n e whether he qualifies for indigent status. To make this determination, I need to know plaintiff's actual gross monthly income for t h e past year. His affidavit of indigency information is contradictory concerning his monthly in c o m e . That is, plaintiff lists his monthly income as $24,000 from self-employment, but in the s o u r c e of income section, he lists $0.00 to 3,000 a m o n t h from a partnership in the M o b i le Gas S t a t io n at the corner of Hwy 100 and Oklahoma in W e s t Allis, W is c o n s in . To clear this up, p l a in t if f may have until December 21, 2010 to submit an amended affidavit of indigency that c o n t a in s his actual gross monthly income from all sources for the last twelve months. I am e n c l o s i n g a blank affidavit of indigency form to plaintiff with this order. 1 0 -c v -7 5 2 -w m c Dockets.Justia.com ORD ER I T IS ORDERED that a decision whether plaintiff M o h a m m a d Rafiq may proceed in f o r m a pauperis in this action is STAYED. Plaintiff may have until December 21, 2010, in which t o amend his affidavit of indigency and return it to the court. If plaintiff fails to provide this r e q u e s t e d financial information in a timely fashion, then the court will deny his request for leave t o proceed in forma pauperis for failure to show that he is indigent.
