his likely need for expert witness testimony in this lawsuit since the March 17,
2011 telephonic pretrial conference, and plaintiff's later-retained attorney has
known of the need for experts since he appeared on December 29, 2011, see 41 .
Plaintiff has known since January 31, 2012 (the date we amended the schedule a
second time 48 ) that his expert disclosures would be due by April 6, 2012. By
incorporating the March 17, 2011 preliminary pretrial conference order, this
court reminded plaintiff that "if a party does not follow the requirements of Rule
26(a)(2) by his deadline to disclose expert witnesses, then this court will not
allow that expert witness to present evidence in this case," and that the calendar
did not allow for extensions, "so the parties should begin looking for expert
witnesses right away if this type of witness might be important for summary
judgment or for trial." ( 19 at 3) Rather than heed these admonitions, plaintiff, by
counsel, waited until the date his expert disclosures were due to seek a 6 week
extension because he hadn't even gathered the information he deemed necessary
to contact potential expert witnesses about his lawsuit, let alone generate any
expert opinions. This is an utterly inadequate excuse, and as defendant confirms
in opposition 57 , the requested extension would greatly prejudice defendant in
this case. As a result of having missed his expert disclosure deadline in this
manner, plaintiff has lost his right to present expert witnesses or their opinions in
