IN THE UNITED STATES DISTRICT COURT FOR THE WESTERN DISTRICT OF WISCONSIN BLACK EARTH MEAT MARI<ET, LLC and I<EMPER BARTLETT DURAND, JR., Plaintiffs, JUDGMENT IN A CIVIL CASE Case No. 14-cv-674-bbc v. VILLAGE OF BLACK EARTH, PATRICK TROGE, PATRICK FREY, TED PRICHETT, JAMES COYLE, THOMAS PARRELL, BETH MARTY and WALT MILLER, Defendants. This action came before the court for consideration with District Judge Barbara B. Crabb presiding. The issues have been considered and a decision has been rendered. IT IS ORDERED AND ADJUDGED that judgment is entered in favor of defendants Village of Black Earth, Patrick Troge, Patrick Frey, Ted Prichett, James Coyle, Thomas Parrell, Beth Marty and Walt Miller granting defendants' motion for summary judgment and dismissing plaintiffs' claims under 42 U.S.C. ยง 1983 based on defendants' alleged violation of plaintiffs' rights under the due process and equal protection clauses of the Fourteenth Amendment and the takings clause of the Fifth Amendment. IT IS FURTHER ORDERED AND ADJUDGED that judgment is entered remanding plaintiffs' state law claims to the Circuit Court for Dane County, Wisconsin for any additional proceedings.
