DECISION AND ORDER granting 25 Motion for Leave to File Second
Amended Complaint.. ..For the aforementioned reasons the Court concludes
that the Plaintiffs motion fot leave to file a Second Amended Complaint
adding Chappaqua Library as an additional Defendant to this action and
asserting additional claims of retaliation against Mount Pleasant is granted.
Because the Plaintiffs Second Amended Complaint adds a new defendant to
this case, and amended summons must issue to the new defendant under the
Iprovisions of Rule 4 of the Federal Rules of Civil Procedure. Although the
Court concludes that referral of this case to the pro bono panel is
I appropriate, discovery as to the Plaintiff's addidional claims of age-based
I retaliation against Mount Pleasant should resume immediatly and Mount
IPleasant's motion for summary judgment on the Plaintiffs underlying claims
for age-based discrimination will continue to be held in abeyance until the

until October 18, 2010. Currently I am running between three part-time civil
service jobs, six days a week, trying to support myself and spending my day
off in Brooklyn helping an eighty year old wheelchair bound cousin with her
shopping and household chores. I have also been cautioned by the Town of
Mount Pleasant about taking time off from work. This leaves little time to
prepare such an important document. Counsel for the Town was contacted
last week for permission and took no position, neither consenting, nor
opposing. I cannot afford another foolish PRO SE procedural error and ask
the Court's approval of this request.ENDORSEMENT: Application Granted.
