Louis Artis v. Finishing Brands Holdings, Inc

Filing

OPINION filed : We affirm the district court s judgment with respect to the hostile environment claim and its conclusion that Artis was not plainly more qualified than Childs for promotion to cell leader. We reverse the district court on the issue of pretext, and conclude that Artis has established a genuine dispute that FB s choice to promote Childs was motivated by racial discrimination, decision not for publication. Jeffrey S. Sutton, Circuit Judge; Raymond M. Kethledge, Circuit Judge and Sandra S. Beckwith, U.S. District Judge, Senior District Judge for the Southern District of Ohio, sitting by designation (AUTHORING).--[Edited 01/27/2016 by YH]
