William Allen v. Roland Colson


PER CURIAM OPINION filed : We reverse the determination that Allen s grand-jury discrimination claim is second or successive, requiring authorization by this court, and reject the argument that the claim must be dismissed as an abuse of the writ. The parties shall address all other issues to the district court. We REMAND for further proceedings, decision not for publication. Damon J. Keith, David W. McKeague and Helene N.
