(3) Defendant's 18 Motion to Dismiss is granted. (4) Defendant's 18 Alternative Motion for a More Definite Statement is denied as moot. 5 This lawsuit is dismissed with prejudice. It is further ORDERED that costs are taxed against plaintiff, for which execution may issue.
