ORDER ADOPTING 12 REPORT AND RECOMMENDATION of the Mag Judge; directing as follows: (1) plaintiff's complaint against Mac Sim Butler Detention Facility is DISMISSED with prejudice prior to service of process in accordance with the provisions of 28 U.S.C. 1915(e)(2)(B)(i); (2) the Mac Sim Butler Detention Facility is DISMISSED as a party to this cause; and (3) this case with respect to the plaintiff's claims against the remaining defendants is referred back to the Mag Judge for further proceedings.
