upon consideration of the Recommendation of the Magistrate Judge, it is
ORDERED that the Recommendation of the Magistrate Judge is ADOPTED and that the
plaintiff’s Motion for Preliminary Injunction is DENIED.
This action is REFERRED back to the Magistrate Judge for further proceedings.
