consideration of the Recommendation, it is ORDERED that

The Recommendation is ADOPTED;

Defendant MERS’s Motion to Dismiss (Doc. # 8) is GRANTED; and

(3)

Plaintiff’s action against Defendant MERS is DISMISSED.

This action as to Plaintiff’s action against the remaining Defendants is referred back
