Voter records are an area where special concerns have prompted the enactment of special legislation to protect privacy and encourage voter participation.1 After
Plaintiffs agreed that the information contained on the forms would be protected and only disclosed to the parties, counsel, and specifically necessary individuals, such as experts, Defendants agreed to produce redacted copies of the voter registration forms [Dkt. No. 140]. County Defendants have produced more than 30,000 voter registration forms received by the county recorders over the past 2½ years, January 24, 2005 through June 30, 2007, that lacked "satisfactory evidence of citizenship" as defined by A.R.S. § 16-166(F). Voter registration forms contain personal information, and the records may only be used for limited purposes, not including the recruitment of plaintiffs or witnesses for a lawsuit. A.R.S. § 16-168(E). ITCA Plaintiffs, however, have given persons not
entitled to the information access to the information and for a use not authorized by A.R.S. § 16-168. Plaintiffs now seek unredacted copies of the more than 30,000 forms. The redacted information (month and day of birth, social security number, driver license number) shall only be accessible to certain individuals, such as the voter or an authorized government official. A.R.S. § 16-168(F); Cf. A.R.S. § 41-4172 (personal identifying information collected or obtained by the governmental agency shall be secure and only accessed as authorized by law). Therefore, the Counties respectfully request that the Court limit access and use of information derived from the forms, deny Plaintiffs' request for unredacted copies of the forms, and establish a deadline of June 30, 2007 for the production of these forms.
