IT IS FURTHER ORDERED dismissing Plaintiff's alle gations pursuant to 29 U.S.C. § 215(a)(3) in Count Three of his Second Amended Complaint with prejudice. IT IS FURTHER ORDERED that the Clerk of Court shall remand this matter to the Superior Court of the State of Arizona in and for the County o f Maricopa. IT IS FURTHER ORDERED denying Defendant's motion for protective order as moot. (Doc. 134 .) IT IS FURTHER ORDERED denying Plaintiff's motion to reconsider and to vacate this Court's previous order.
