Through undersigned counsel, named Defendants Maricopa County Sheriff,
Joseph M. Arpaio, and the Maricopa County Sheriff’s Office ("MCSO") agree with the
United States that substantial compliance under the June 2, 2011 Agreement has occurred.
These Defendants, however, disagree with the United States’ contention that
the MCSO has only cooperated with the United States’ underlying Title VI investigation
since the filing of this action.

Appropriate cooperation, along with the rightful

questioning of the scope and propriety of the United States’ investigation, occurred prior
to the filing of this action.

The United States has notified the aforementioned Defendants of its

determination of substantial compliance under the June 2, 2011 Agreement, and counsel

3

for these Defendants has acknowledged this determination. See Exhibit 1.

Accordingly, pursuant to the June 2, 2011 Agreement and the June 3, 2011

5

Order of this Court (Snow, J.) (Dkt. 62), the dismissal of this action on August 2, 2011 is

6

mandated.
