This action shall be remanded to Maricopa County Superior Court as a result of the Third-Party Defendant's untimely removal. IT IS FURTHER ORDERED that Pla intiff's Motion for Leave to Supplement Plaintiff's Motion to Strike Third-Party Complaint (Dkt. 10) is DENIED as moot in light of the Court's order remanding this action to Superior Court.
