ORDER The Report and Recommendation of the Magistrate Judge (Doc. 35 ) is accepted. Defendants' Motion to Dismiss (Doc. 28 ) is granted. Plaintiff's Motion to Strike (Doc. 31 ) is denied. Plaintiff's section 1983 claim (Count I) is dismissed for failure to exhaust administrative remedies and her state-law claim (Count II) is remanded to the Maricopa County Superior Court.
