ORDER - The Defendants' Motion to Dismiss Second Amended Complaint (Doc. 66 , sealed) and Amended Motion to Dismiss Second Amended Complaint (Doc. 68 , redacted public version) are granted with respect to Counts I and II of the Second Amende d Complaint. The Clerk shall enter judgment dismissing Counts I and II of the Second Amended Complaint (Doc. 58 ) with prejudice. The Court finds no just reason for delay in entry of this partial judgment. Counts III, IV, V, and VI of the Second Amended Complaint shall be remanded to the Superior Court of the State of Arizona for Maricopa County. The Clerk is directed to terminate this case.
