Defendant Revenue Science, Inc. ("RSI") hereby applies to the Court ex parte
2 for an Order enlarging the page limit for RSI's Responsive Claim Construction Brief, 3 filed herewith. Such an increase in the page limit is necessary in order to address the 4 lengthy ValueClick's Opening Claim Construction Brief, which at 32 pages is 7 5 pages longer than the page limit of 25. RSI's Opening Claim Construction Brief, by 6 contrast, was within the page limit of 25. 7
RSI has meet and conferred with ValueClick and ValueClick has agreed to the
8 extension. 9
RSI has made every effort to shorten its Responsive Claim Construction Brief
10 and address only those issues not previously addressed in its Opening Brief. 11 However, ValueClick's inaccurate description of the patents-in-suit and the 12 applicable claim construction law has required RSI to address these issues more 13 extensively in its Responsive Claim Construction Brief. Accordingly, RSI 14 respectfully requests that the Court permit RSI to enlarge the page limit of its 15 Responsive Claim Construction Brief to 31. 16 17 Dated: November 19, 2007 18 19 20 21 22 23 24 25 26 27
