Specifically, the Civil Cover Sheet submitted on November 4, 2010, erroneously indicated in Section VII that the subject lawsuit is a "Trademark" case, when in fact it is a trade dress case. Accordingly, plaintiff has designated this as an "Other Statutory Actions" suit. Such designation eliminates the reporting requirement pursuant to 15 U.S.C. § 1116.
