Bigelow (“Defendants”), shall move before the Honorable Dennis M. Cavanaugh, United States
District Court for the District of New Jersey, Martin Luther King, Jr. Federal Building & United
States Courthouse, 50 Walnut Street, Newark, New Jersey 07102 for an Order granting their
Motion to Dismiss for lack of personal jurisdiction under Fed. R. Civ. P. 12(b)(2); improper
venue under Fed. R. Civ. P. 12(b)(3) and 28 U.S.C. § 1406; and failure to state a claim upon
which relief can be granted, in part, under Fed. R. Civ. P. 12(b)(6).
In the alternative,
Defendants shall move for an Order granting their Motion to Transfer Venue under 28 U.S.C. §
1406 or 28 U.S.C. § 1404.
