After reviewing the Joint Ex Parte Application To Approve The Settlement

Agreement And Dismiss The Action Under Fed.R.Civ.P. 41(a) the supporting

exhibits, and in view of the Settlement Agreement reached by the parties through
5
the April 27, 2012 Mediation with the assistance of the Court’s Mediation Office,
6
and good cause appearing therefor IT IS HEREBY ORDERED, as follows:

1. The Joint Ex Parte Application To Approve The Settlement Agreement
And Dismiss the Action Under Fed.R.Civ.P. 41(a) is GRANTED;
2. The parties are directed to file the Stipulation For Dismissal attached as

Exhibit A to the Joint Ex Parte Application To Approve The Settlement
12
Agreement And Dismiss the Action Under Fed.R.Civ.P. 41(a), which will then be
13
entered by the Court; and

3. The Court will address the remaining issues of the January 3, 2011 lien
15
at D/E 9 and the July 19, 2011 lien at D/E 43 and the disposition of the settlement
16
funds in this action in due course.
