IT IS HEREBY STIPULATED by and between Plaintiff MGA Entertainment, Inc.

21 (“MGA”) and defendants MATTEL, INC. and ROBERT A. ECKERT by and
22 through their respective counsel, that hearing on defendants’ Motion to Dismiss
23 Plaintiff’s First Amended Complaint rescheduled by the Court to be heard on
24 February 21, 2012 (Docket 39), be rescheduled for February 17, 2012 at 8:30 a.m.,
25 if agreeable to the Court.

This request is made by lead counsel for Plaintiff who is scheduled to begin

27 a four (4) week jury trial in Santa Barbara Superior Court on February 21, 2012.
