On November 20, 2014, the Court informed the Parties that Judge Gary

A. Feess is scheduled to retire before the resolution of this case.
2.

The Court permitted the Parties an opportunity to decide whether to

consent to one of the available magistrates or to turn to the Wheel.
3.

On November 25, 2014, the parties agreed to consent to Judge Susanne

H. Segal, or in the alternative, Judge Jay C. Gandhi as the judge for all purposes in
this action.
4.

On December 5, 2014, Judge Segal informed the parties that she and

Judge Gandhi are unable to preside over this action.
5.

The parties met and conferred and agreed to consent to have Judge

John E. McDermott conduct all further proceedings in this case, including trial and

final judgment.

The parties will meet and confer and determine at a later time whether

to hold a settlement conference before Judge Segal or Judge Gandhi.
