Plaintiff and counterclaim defendant LegalZoom.com, Inc. (“LegalZoom”) and

defendant and counterclaimant Rocket Lawyer Incorporated (“RLI”) hereby stipulate

3

as follows:
1.

On December 19, 2014, the Court issued a minute order setting a status

5

conference for January 7, 2015, at 10:30 a.m., and required all lead trial counsel to be

6

present at the status conference.
2.

Lead trial counsel for plaintiff LegalZoom, Fred Heather, represents that

8

he has a trial which is scheduled to proceed on January 7, 2015, in Los Angeles

9

Superior Court, Case No. BF045218, and which may prevent his participation at the

10

status conference. Mr. Heather’s partner, Aaron Allan, who will be second chair at

11

any trial in the present action, is available to participate in the status conference.

In the event that Mr. Heather is unavailable to participate in the status

13

conference on January 7, 2015, LegalZoom requests to proceed with the status

14

conference on that date rather than postponing it, and RLI has no objection to

15

proceeding without Mr. Heather’s participation.
Therefore, the parties agree, subject to the Court’s approval, that the status

conference currently scheduled for January 7, 2015, should proceed on that date even

18

if Mr. Heather is unable to attend.
