MINUTES (IN CHAMBERS) ORDER GRANTING Plaintiff's Motion to Remand 9 and VACATING Defendant's Motion to Dismiss 13 by Judge Beverly Reid O'Connell: The Court finds SPS has failed to establish Quality's status as a nominal party . This matter's removal was therefore improper under section 1441 and section 1446, as complete diversity is lacking and Quality failed to join in or consent to the notice of removal. Because the Court lacks subject matter jurisdiction under sec tion 1332, Plaintiff's Motion to Remand is GRANTED, and this matter is REMANDED to the Superior Court of California, County of Los Angeles, Central District.
