At all relevant times, Defendant MANDALAY CORP. was corporation with minimum contacts in the State of California, duly licensed an 12 13 incorporated under the laws of Nevada, and as a subsidiary of Defendant MGM, i 14 believed to be the owner, manager and operator of the Mandalay Bay premises. 15 16 17 4. That the true names and capacities whether individual, corporate associate or otherwise, of the Defendants herein designated as DOES 1 through I 00 6 7 inclusive, are unknown to Plaintiff at the time of filing this Complaint and, therefore 8 Plaintiffs sues said Defendants by fictitious names. Plaintiff realleges and incorporates by reference, every allegatio contained in this Complaint, as though set forth fully herein. 20 21 22 13. On October 1, 2017, Plaintiff MS. MAGGIORE was an attendee at th Route 91 Harvest Festival, a three-day music festival featuring numerous artist 23 which took place at the Las Vegas Village. 24 25 26 14. During Jason Aldean's performance, PADDOCK, opened fire into th crowd, which included MS. MAGGIORE and her husband. PAD DOCK fire multiple rounds of ammunition into the crowd of people at the Las Vegas Villag COMPLAINT FOR DAMAGES - 6 18 Doc# 1 Page# 7 - Doc ID= 1742818687 - Doc Type= OTHER (Page 8 of 25) • • from his hotel suite on the 32"d floor of Mandalay Bay. MS. MAGGIORE and he 2 husband were forced onto the ground and attempted to take cover; MS 3 4 s MAGGIORE's husband got on top of MS. MAGGIORE to protect her from the gu fire. MS. MAGGIORE was struck by bullet casings/bullet fragments, and people al 6 7 8 around her got shot. 15. During an approximately 11-minute stretch of rapid-fire shooting 9 PAD DOCK killed 58 people, and injured hundreds of other concert goers at the La 10 11 12 Vegas Village. Upon information and belief, PADDOCK used bump stocks to fir his weapons rapidly, mimicking automatic fire. 13 14 IS 16. Prior to the shooting, PADDOCK was able to use VIP status conferre on him as a high-stakes gambler, which included exclusive access to a servic 16 elevator at Mandalay Bay, to stockpile weapons and ammunition in his hotel suit 17 18 19 over the days leading up to the mass shooting. PAD DOCK kept a "Do Not Disturb' sign on his hotel room door for days leading up to the shooting. Upon informatio 20 21 22 and belief, prior to the commencement of his shooting spree, PADDOCK installe security cameras on his hotel room door, in a service cart, and in the hallway 23 PADDOCK used the cameras as surveillance and security to thwart law enforcemen 24 25 26 c,:, 28 and prolong his ,shooting spree. 17. PAD DOCK smashed two windows of his hotel suit and open fire int the crowd of concert-goers at the Las Vegas Village. At all relevant times, Defendants DOES 1 through 100 were as-ye unidentifi~d employees or agents of MGM, MA.NDALA Y CORP., MG 6 7 RESORTS FESTIVAL, LIVE NATION, ONENATIONGROUP, CSC, PAD DOC , 8 or some other entity whose acts or omissions are believed to have contributed to th 9 circumstances giving rise to Plaintiffs injuries and damages. At all relevant times, Defendants MGM, and/or MANDALAY CORP. and/or DOES I through 100 had a duty of reasonable care in the protection an 22 safeguarding of persons on all Mandalay Bay premises. 23 24 21. Q>l• ~~ COMPLAINT FOR DAMAGES - 8 20 Doc# 1 Page# 9 - Doc ID= 1742818687 - Doc Type= OTHER (Page 10 of 25) • • safe condition, including but not limited to: 1) failing to properly surveil peopl 2 coming and going from the hotel; 2) failing 'to monitor the hotel premises wit 3 4 5 closed-circuit television (CCTV); 3) failing to timely respond or otherwise act upo PADDOCK's shooting of Mandalay Bay Security Officer Jesus Campos, who ha (, 7 8 gone to the 32 11 d floor to check on an alert coming from another guest room, and wh was shot six minutes prior to PADDOCK's commencement of shooting towards th 9 concert venue; 4) failing to notice or take precautions against PADDOCK 's deliver 10 11 12 of guns and/or ammunition to his hotel room; 5) failing to adequately prevent o timely discover PADDOCK's breaking-open of his hotel room windows; 6) fail in 13 14 15 to notice or take action against PADDOCK's set up of surveillance outside his hote room; 7) failing to adequately prevent or timely discover PADDOCK's opening o 16 his hotel room windows; 8) failing to adequately train and supervise employees o 17 18 19 the reporting and discovery of suspicious individuals and/or person and/or activity 8) ignoring the "Do Not Disturb" sign on PADDOCK's door; and 9) failing t 20 21 employ adequate safety measures. 22 23 24 25 22. Defendants MGM, and/or MANDALAY CORP., and/or DOES 1 through l 00 are further liable for the negligence of their employees pursuant to th doctrine of respondeat superior, and the negligence of their agents under th 26 ~:: 27 doctrine of Vicarious Liability. MAGGIORE, and the community at large. 9 10 11 24. ' As a direct and proximate result of Defendant MGM's, and/o MANDALAY CORP. 's, and/or DOES 1 through lOO's negligence, Plaintiff MS 12 13 MAGGIORE was caused to incur injury to her body and mind, past and futur 14 medical expenses, past and future pain and suffering, past and future sever 15 16 17 18 emotional distress, and anticipated lost past and future income. 25. Due to Defendant MGM's, and/or MANDALAY CORP.
