Plaintiff filed an unlawful detainer complaint against

Defendant in state court on February 11, 2014. (Dkt. No. 1)

Defendant removed the action to this court on June 13, 2014 on the
21
basis of federal question jurisdiction. (Id.) It appears, however,
22
that there is no federal subject matter jurisdiction in this
23
action. Plaintiff’s unlawful detainer complaint raises only issues
24
of state law, and the amount in controversy does not exceed
25
$75,000.

District courts have original jurisdiction over “all civil
27
actions arising under the Constitution, laws, or treaties of the
28
United States. 28 U.S.C. § 1331. Though Defendant asserts various

federal defenes, “[u]nder the longstanding well-pleaded complaint
2
rule, . . . a suit ‘arises under’ federal law only when the
3
plaintiff’s statement of his own cause of action shows that it is
4
based upon federal law.”
