1 TO THE COURT, ALL PARTIES AND THEIR COUNSEL OF RECORD:
PLEASE TAKE NOTICE that on December 22, 2008, at 8:30 a.m. or as

3 soon thereafter as may be heard, defendant EYGN Limited (“EYGN”) will move for
4 judgment on the pleadings for lack of personal jurisdiction pursuant to Rule 12(c) of the
5 Federal Rules of Civil Procedure dismissing Plaintiff’s complaint in its entirety before the
6 Honorable David O. Carter, in Courtroom 9D of the United States District Court for the
7 Central District of California, 411 West Fourth Street, Santa Ana, California 92701. The
8 grounds for the motion are that the complaint fails to allege a basis for personal
9 jurisdiction over EYGN, and the undisputed facts confirm that personal jurisdiction does
10 not exist over EYGN in this action. This motion is based on this notice; the
11 accompanying Memorandum of Points and Authorities in Support of EYGN’s Motion for
12 Judgment on the Pleadings for Lack of Personal Jurisdiction; the declarations and other
13 evidence filed in support of EYGN’s motion, including the declarations of Victoria
14 Cochrane, Larry J. Haynes and Craig S. Mende; all prior pleadings and proceedings in
15 this matter; and all oral and written evidence to be presented at the hearing, if any, on this
16 motion.

On August 1, October 21 and October 29, 2008, counsel for the parties met and

18 conferred concerning this motion pursuant to Local Rule 7-3.
