WHEREAS, on May 25, 2010, the Court ordered the Final Pretrial Conference to be held on July 19, 2010, or such other time that the Court deemed appropriate; WHEREAS, on July 1, 2010, due to the rescheduling of the settlement conference for July 19, 2010, the Court postponed the Final Pretrial Conference to July 23, 2010 at 8:30 a.m.; WHEREAS, lead trial counsel for Plaintiffs is scheduled to travel from New York City to Maine on Friday, July 23, 2010 for an important family obligation, and is not scheduled to depart from Maine until Sunday, July 25, 2010; WHEREAS, lead trial counsel for Plaintiffs is available to attend a Final Pretrial Conference on Tuesday, July 27, 2010, and lead trial counsel for Defendants is also available on that date; and WHEREAS, lead trial counsel for Plaintiffs could also appear for a Final Pretrial Conference on Monday, July 26, 2010, as could lead trial counsel for Defendants, although this date is less desirable for Plaintiffs' counsel due to the difficulty of traveling from Maine to Santa Ana in a single day; NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED by the parties, through their undersigned counsel of record, and subject to approval of the Court, that the Final Pretrial Conference shall take place on July 27, 2010 at 11:00 a.m., or such other hour that the Court deems appropriate.
