DeVore and Justin Hart file this joint stipulation regarding service and seeking the Court's permission for an extension of time to answer, move or otherwise respond to the Complaint. WHEREAS on April 17, 2009, Plaintiffs Don Henley and Mike Campbell filed a Complaint in the above-referenced action in the Central District of California; WHEREAS on April 18, 2009, Defendant Justin Hart was served at his home; WHEREAS on April 20, 2009, Chris Arledge, of Turner Green Afrasiabi & Arledge LLP, contacted counsel for Plaintiffs, stating that he would accept service on behalf of Defendant Charles S. DeVore; WHEREAS copies of the Summons and Complaint were served on Mr. Arledge by email from Charles S. Barquist on April 21, 2009; WHEREAS Defendant Hart's response to the Complaint is currently due on May 8, 2009; WHEREAS Defendant DeVore's response to the Complaint is currently due on May 11, 2009; WHEREAS an extension of the time to respond to the Complaint would allow Mr. Arledge to better coordinate with his clients in responding to the Complaint and Summons, given that Defendant Hart resides in the state of Virginia, whereas Defendant DeVore resides in the state of California; and WHEREAS the parties have made no prior requests for extensions to the Court.
