(ECF NO. 2) CORIZON HEALTH, et al., 15 ORDER DIRECTING PAYMENT OF INMATE FILING FEE BY FRESNO COUNTY JAIL Defendants. 16 17 Plaintiff is a county jail inmate proceeding pro se pursuant to 42 U.S.C. § 1983 and has 18 requested leave to proceed in forma pauperis pursuant to 28 U.S.C. § 1915. 19 Plaintiff has made the showing required by § 1915(a) and accordingly, the request 20 to proceed in forma pauperis will be granted. Still, Plaintiff remains obligated to pay the 21 statutory filing fee of $350.00 for the action. 28 U.S.C. § 1915(b)(1). She must make 22 monthly payments in the amount of twenty percent of the preceding month=s income 23 credited to Plaintiff=s trust account. The Fresno County Jail is required to send to the 24 Clerk of the Court payments from Plaintiff=s account each time the amount in the account 25 exceeds $10.00 until the statutory filing fee is paid in full. 28 U.S.C. ' 1915(b)(2). 26 27 28 In accordance with the above and good cause appearing therefor, IT IS HEREBY ORDERED that: 1. Plaintiff's application to proceed in forma pauperis (ECF No. 2) is 1 1 GRANTED; 2 2. The Sheriff for Fresno County or her designee shall collect payments 3 from Plaintiff=s prison trust account in an amount equal to twenty per cent 4 (20%) of the preceding month=s income credited to the inmate=s trust 5 account and shall forward those payments to the Clerk of the Court each 6 time the amount in the account exceeds $10.00, in accordance with 28 7 U.S.C. § 1915(b)(2), until a total of $350.00 has been collected and forwarded 8 to the Clerk of the Court. The payments shall be clearly identified by the 9 name and number assigned to this action. 10 3. The Clerk of the Court is directed to serve a copy of this order and a copy 11 of Plaintiff=s in forma pauperis application on the Sheriff for Fresno County, via the 12 court's electronic case filing system (CM/ECF). 13 4. The Clerk of the Court is directed to serve a copy of this order on the 14 Financial Department, U.S. District Court, Eastern District of California, 15 Sacramento Division. 16 5. Within sixty (60) days of the date of service of this order, Plaintiff shall 17 submit a certified copy of her inmate trust account statement for the six-month 18 period immediately preceding the filing of the complaint, if Plaintiff has not already 19 done so. 20 21 22 IT IS SO ORDERED.
