This is a civil rights case filed pro se by a detainee. In an order entered December 16,

2016, the court found that plaintiff had failed to state a claim and dismissed the second amended
16
complaint with leave to amend after discussing the deficiencies of the complaint. The twenty-
17
eight days to amend have passed and plaintiff has not filed a third amended complaint or otherwise
18
communicated with the court. This case is therefore DISMISSED.
