C-04-3111 JSW JOINT STIPULATION TO CONTINUE CASE MANAGEMENT CONFERENCE Case 3:04-cv-03111-JSW Document 81 Filed 04/23/2007 Page 2 of 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 All parties, through counsel, respectfully request the Court to continue the Case Management Conference currently scheduled for Friday, May 11, 2007 at 1:30 p.m. as well as the April 27, 2007 deadline for submitting a proposed preliminary injunction. Plaintiffs intend to file a Petition for a Writ of Certiorari with the U.S. Supreme Court in this case as a result of the U.S. Court of Appeals for the Ninth Circuit's Opinion reversing in part, vacating in part, and remanding this Court's Order granting Plaintiffs' Motion for a Preliminary Injunction. The outcome of this Petition has the potential to significantly affect both the legal questions at issue in this case--including the scope of a preliminary injunction--and the prospects for settlement. Consequently, the parties believe that the Case Management Conference and the proposed injunction would best be handled once Plaintiffs' Petition has been fully resolved by the U.S. Supreme Court. The parties respectfully request that the Case Management Conference currently scheduled for May 11, 2007 be postponed until after the expiration of any time period for filing a Petition for a Writ of Certiorari with the U.S. Supreme Court or, if such a Petition is filed, until after the U.S. Supreme Court has fully disposed of the matter. The parties also request that their stipulation and proposed form of injunction be due concurrently with their joint case management conference statement, the due date of which will be determined based on the date of the continued Case Management Conference.
