The version that I read of your "Notice" is materially inaccurate. As I told you by email yesterday, we have planned a telephonic meet-and-confer under the rules for 10 a.m. Eastern Daylight Time tomorrow, August 18, to hear and address any concerns you may have about the proposed settlement. Of course, although we are prepared to listen to your concerns, you should understand, as I have told you before, that you are no longer our client; that you are not a class representative because Judge Alsup disqualified you from being a class representative; and that you are not a member of the class because you did not sign a GLA during the class period. Nevertheless we will comply with the letter and spirit of the Courts Order. In advance of the call, you should know that we stand by our public filings in this case about the fairness and appropriateness of the settlement and the plan of distribution to the Class. The dial-in number for the meet-and-confer call at 10 a.m. Eastern Daylight Time on Tuesday, August 18 is 1 866 922 3257. The passcode that you should dial in when you reach that number is: 41641978#. In case we have to report what was said on the call to the Court, I have asked a certified court repoprter to join the call in order to transcribe it. I will send you a copy of the transcription after it is prepared. I look forward to speaking with you then. If you do not participate (or if you do not propose an alternative time for the call if this time is inconvenient for you), we will inform the Court of your apparent refusal to participate in the meet-and-confer process.
