track the backup, restore, check-in and check-out o f T N customers' environments and environment components. O n February 4, 2008, Defendants produced all content from the BakTrak database through exported Excel spreadsheets prior to John B a u g h ' s Rule 30(b)(6) deposition on February 6-7, 2008. The exported native spreadsheets contained all TN backup and restore activity tracked in BakTrak through approximately the end o f January 2008. Defendants then produced the entire native version o f the BakTrak database to Plaintiffs on March 12, 2008 and included data through February 2008. O n April 20, 2009, Defendants updated the BakTrak production pursuant to the Expanded Discovery Timeline Agreement to include data through October 31, 2008. This is the copy o f BakTrak referenced in the Motion. 8. Further, recognizing the special importance that the SAS database has to this case,
Defendants started producing SAS in native form in 2007. The SAS database was designed to document TN support services activities, including managing o f cases, scoping (researching) problems, development o f fixes o r updates and testing o f fixes or updates. Defendants produced a complete subset o f the SAS database containing the six customers identified in paragraphs 76-80 o f P l a i n t i f f s ' F i r s t A m e n d e d C o m p l a i n t o n S e p t e m b e r 2 1 , 2 0 0 7 . D e f e n d a n t s p r o d u c e d a complete subset o f the SAS database with respect to the 69 additional customers identified by Plaintiffs on October 5 and N o v e m b e r 9 , 2 0 0 7 . Finally, Defendants produced the entirety o f the SAS database containing all o f T N ' s PeopleSoft and J.D. Edwards customers on December 4 , 2 0 0 7 . This production included T N ' s activities though the end o f April 2007. As part o f the Expanded Discovery Timeline Agreement, on March 6, 2009, Defendants further updated the SAS database production to include T N activity through October 31, 2008. This is the copy o f SAS referenced in Plaintiffs' Motion.

Defendants first produced the entirety o f the dotProject database to Plaintiffs on
March 2 6 , 2 0 0 8 . This production included T N ' s activities though the end o f June 2007. The dotProject database contains information regarding the downloads for a particular customer, i n c l u d i n g t h e d a t e t h e d o w n l o a d s w e r e c o m p l e t e d a n d t h e c r e d e n t i a l s a n d p r o d u c t questionnaires provided by the customer. Id. at 141 :24-142:25. Subsequently, he explained that " . . . I had thought that all o f our environments were in SAS Environment Portal and dotProject, b u t it was only in performing research over the last few days in preparation for this deposition that we found, looking at BakTrak, that there was some additional environments that were not in this document." See Ex. B-2, at 182:25-183 :6. 27. Defendants produced the BakTrak exports on February 4 , 2 0 0 8 prior to the John

As noted in Paragraph 15, Defendants produced the metadata report for DCITBUOl_G in January 2008 and the files by October 2008. 30. Beginning on February 6, 2008, Plaintiffs obtained testimony regarding the

structure o f the environments and the underlying databases. See Ex. B-1, at 36:16-37:12,84:2186:9. John Baugh testified in early February 2008 that TN obtained its database platforms from a variety o f vendors, including Oracle. See id. On April 1, 2008, former TN employee Kathy Williams testified regarding the different component parts o f a~ e n v i r o n m e n t - i n c l u d i n g the "relational database p 1 a t f o r m " - a n d the naming conventions for the databases at TN. Ex. B-3, at 47:7-13, 107:13-108:9. On Apri12, 2008, former TN employee Catherine Hyde also testified to the naming conventions for the database platforms at TN. See Ex. B-4, at 112:12-113:16. 32. Moreover, the two documents used by Plaintiffs as exhibits to the April 2009

However, in the review o f these servers, Plaintiffs did not mark the database files as "produce" files and only marked some files as "record." The metadata from the requested "record" files was produced by August 2008. As noted above, Plaintiffs did not request the production o f any "record" files until March 16,2009. 34.
