On October 28, 2009, the court issued an order of dismissal in which it explained that the habeas petition did not state a claim upon which relief may be granted, and granted petitioner leave to amend to file an amended petition by November 20, 2009. That deadline has long passed, and petitioner has not filed an amended petition or otherwise communicated with the court. Accordingly, this action is dismissed for failure to state a claim upon which habeas relief may be granted. The clerk shall close the file. IT IS SO ORDERED.
